Terms of Service

These Terms of Service (the "Terms") describe the agreement between you ("you", "Client") and PivotAd, operated from Gærdesmuttevej 10, Hørsholm, Denmark ("PivotAd", "we"), under which you may use the PivotAd website and services at pivotad.ai (the "Service"). By creating an account, joining the waitlist, approving a campaign, or otherwise using the Service, you agree to these Terms. If you use the Service on behalf of a company, you confirm you are authorised to bind that company.
1. What the Service is
PivotAd creates and manages Google Ads Search campaigns on your behalf. Based on your answers and your website's content, PivotAd generates a campaign plan — keywords, ads, negative keyword lists, budgets and settings — which you review and approve before anything is created. Campaigns are created and managed through the official Google Ads API in a Google Ads account set up for your business.
2. Your Google Ads account belongs to you
Your Google Ads account is created under PivotAd's manager account, and you are made an administrator of your account from day one. If you stop using PivotAd, we disconnect our manager access and you keep the account, its history and its data. We will never hold your advertising account hostage.
3. Advertising costs are paid to Google — not to us
Your advertising budget is paid by you directly to Google, using a payment method you enter in Google's own billing system. PivotAd never sees, stores, collects or re-bills your advertising spend, and no advertising funds ever pass through PivotAd. Your advertising billing relationship is with Google and is governed by the Google Payments and Google Ads terms. Google's advertising policies apply to all campaigns; Google may disapprove ads or suspend accounts under its own rules, which are outside PivotAd's control.
4. Fees for the Service
During the beta, the free tier includes one advertising account and the standard campaign launch with everyday management, at no charge. A paid tier for multiple accounts and campaigns has been announced ($19/month plus 2% of ad spend) and will be offered under separate, clearly presented billing terms before you are ever charged. We will never charge you without your explicit sign-up to a paid plan.
5. Your responsibilities
- Accurate facts. Campaigns are built from your answers. You are responsible for the accuracy of the business facts you provide — including your legal business name and registration number, which must match your official registration documents (Google uses them for advertiser verification).
- The review step. Approving a campaign plan on the review screen is your authorisation for PivotAd to create it in your account. Check it — that is the point of the step.
- Your content and claims. You confirm that your website, your business claims and any content you provide are lawful, accurate, and yours to use, and that your business complies with Google Ads policies in the countries you target.
- Your account credentials. Keep your login details secure and tell us promptly about any unauthorised use.
6. Our role and its limits
PivotAd applies professional campaign-building practices, but advertising outcomes depend on markets, competition, your website, your offer and Google's systems. We do not promise any particular results — impressions, clicks, costs, conversions or revenue. The Service is provided "as is", and to the maximum extent permitted by law we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.
7. Data and privacy
- We store the answers you give at intake, a snapshot of the public pages of your website used to build your campaigns, your campaign structures and performance data from the Google Ads API, and records of your approvals.
- We do not collect data about your customers or your website's visitors, and we place no tracking on your website. Conversion tracking, where set up, uses Google's own tags, which send data to Google under Google's terms.
- We use your data only to provide and improve the Service, and we never sell it. PivotAd operates from Denmark and handles personal data in accordance with the GDPR. For questions or deletion requests, contact us at the address below.
8. Intellectual property
PivotAd owns the Service — the software, the campaign-generation methodology, the playbook rules, designs and documentation. You own your content, your trademarks and your business data, and you grant us the licence needed to use them for the sole purpose of providing the Service (for example, using your business name and website content to write your ads). Feedback you give us about the Service may be used to improve it.
9. Acceptable use
You may not use the Service for unlawful, deceptive or harmful advertising; for businesses or content prohibited by Google Ads policies; or to probe, overload, reverse engineer or resell the Service. We may decline, pause or end service to any business at our reasonable discretion — your account and its history remain yours per Section 2.
10. Liability
To the maximum extent permitted by law, PivotAd is not liable for indirect or consequential losses, lost profits, or losses caused by Google's decisions (including ad disapprovals, account suspensions or verification outcomes), and our total liability under these Terms is limited to the fees you paid to PivotAd for the Service in the six months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
11. Term and ending the agreement
These Terms apply while you use the Service. You may stop at any time; we may terminate with reasonable notice, or immediately for breach. On termination we disconnect our manager access (you keep your account, per Section 2), any unpaid Service fees become due, and Sections 6–10 and 12–13 survive.
12. Governing law and disputes
These Terms are governed by the laws of Denmark. Before any formal step, please contact us first — most issues are resolved quickly and informally. Disputes that cannot be resolved informally are subject to the courts of Denmark, unless mandatory law in your country of residence provides otherwise.
13. Changes and notices
We may update these Terms as the Service evolves; material changes will be notified on the Service or by email, and the current version always lives at pivotad.ai/terms. Notices to PivotAd: contact@pivotad.ai or PivotAd, Gærdesmuttevej 10, Hørsholm, Denmark. Notices to you go to your account email.
