Terms of Service

What changed on 19 September 2026: sections 5 and 7 now cover the conversion-tracking code you can choose to install on your own website, and who is responsible for cookie consent there.
These Terms of Service (the "Terms") describe the agreement between you ("you", "Client") and PivotAd, operated by Kreativ Group from Gærdesmuttevej 10, Hørsholm, Denmark ("PivotAd", "we"), under which you may use the PivotAd website and services at pivotad.ai (the "Service"). By creating an account, joining the waitlist, approving a campaign, or otherwise using the Service, you agree to these Terms. If you use the Service on behalf of a company, you confirm you are authorised to bind that company.
1. What the Service is
PivotAd creates and manages Google Ads Search campaigns on your behalf. Based on your answers and your website's content, PivotAd generates a campaign plan — keywords, ads, negative keyword lists, budgets and settings — which you review and approve before anything is created. Campaigns are created and managed through the official Google Ads API in a Google Ads account set up for your business.
2. Your Google Ads account belongs to you
Your Google Ads account is created under PivotAd's manager account, and you are made an administrator of your account from day one. If you stop using PivotAd, we disconnect our manager access and you keep the account, its history and its data. We will never hold your advertising account hostage.
When you create an account through PivotAd, we create it under the Google Ads manager account of Kreativ Group, the company operating PivotAd, and ask Google to invite the email address you give us as the account's administrator; Google sends that invitation directly to you. The new account has no payment method until you add one in Google Ads, and Google runs no ads before you do. You can create one account this way; any other accounts you own can be linked instead.
3. Advertising costs are paid to Google — not to us
Your advertising budget is paid by you directly to Google, using a payment method you enter in Google's own billing system. PivotAd never sees, stores, collects or re-bills your advertising spend, and no advertising funds ever pass through PivotAd. Your advertising billing relationship is with Google and is governed by the Google Payments and Google Ads terms. Google's advertising policies apply to all campaigns; Google may disapprove ads or suspend accounts under its own rules, which are outside PivotAd's control.
4. Fees for the Service
Every account can create and review a limited number of AI-written campaign plans at no charge. Creating campaigns in your Google Ads account and managing them is part of the Pro plan, a monthly subscription at the price shown on the Plan & billing page: currently $19 per month plus 2% of the advertising spend of the campaigns created through PivotAd, excluding any VAT that applies. The 2% is calculated from Google's daily spend reports for those campaigns, converted to US dollars at the daily exchange rate, and added to your next monthly invoice. Free trial. The Pro plan starts with a free trial of the length shown on the Plan & billing page (currently 14 days). You add a payment method when the trial starts; nothing is charged until it ends, and you can cancel at any time before then at no cost. When the trial ends, the monthly fee is charged and the subscription continues as described below. The trial is available once per customer, and advertising spend during the trial is not subject to the 2% fee. Spend from before your subscription started, or during your trial, is never charged. Payments are processed by Stripe; PivotAd never sees or stores your card number. The subscription renews monthly until you cancel, which you can do at any time from the billing portal; it then stays active until the end of the period you have paid for. Except where the law requires otherwise, fees already paid are not refunded for partial months. We may change prices with at least 30 days' notice by email; the new price applies from your next renewal after the notice period. We will never charge you without your explicit sign-up to a paid plan. Your advertising budget is separate: Google bills it directly to your Google Ads account, never through PivotAd.
5. Your responsibilities
- Accurate facts. Campaigns are built from your answers. You are responsible for the accuracy of the business facts you provide — including your legal business name and registration number, which must match your official registration documents (Google uses them for advertiser verification).
- The review step. Approving a campaign plan on the review screen is your authorisation for PivotAd to create it in your account. Check it — that is the point of the step.
- Your content and claims. You confirm that your website, your business claims and any content you provide are lawful, accurate, and yours to use, and that your business complies with Google Ads policies in the countries you target.
- Your website, its tracking code and cookie consent. Conversion tracking works only if you install the code PivotAd shows you; installing, keeping or removing it is your decision. You are responsible for your website's compliance with privacy and cookie rules — including, where the law requires it (for example for visitors in the European Economic Area, the United Kingdom or Switzerland), asking visitors for their consent before Google Ads tracking runs, for instance with a cookie banner that covers Google Ads. Without that consent Google may not count those results.
- Your account credentials. Keep your login details secure and tell us promptly about any unauthorised use.
6. Our role and its limits
PivotAd applies professional campaign-building practices, but advertising outcomes depend on markets, competition, your website, your offer and Google's systems. We do not promise any particular results — impressions, clicks, costs, conversions or revenue. The Service is provided "as is", and to the maximum extent permitted by law we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.
7. Data and privacy
- We store the answers you give at intake, a snapshot of the public pages of your website used to build your campaigns, your campaign structures and performance data from the Google Ads API, and records of your approvals.
- We do not collect data about your customers or your website's visitors, and we never install anything on your website. Conversion tracking, where you set it up, runs on code you paste in yourself: Google's own tag plus a few lines from PivotAd that report to Google only, under Google's terms. Nothing about your visitors is sent to PivotAd.
- We use your data only to provide and improve the Service, and we never sell it. PivotAd operates from Denmark and handles personal data in accordance with the GDPR. For questions or deletion requests, contact us at the address below.
8. Intellectual property
PivotAd owns the Service — the software, the campaign-generation methodology, the playbook rules, designs and documentation. You own your content, your trademarks and your business data, and you grant us the licence needed to use them for the sole purpose of providing the Service (for example, using your business name and website content to write your ads). Feedback you give us about the Service may be used to improve it.
9. Acceptable use
You may not use the Service for unlawful, deceptive or harmful advertising; for businesses or content prohibited by Google Ads policies; or to probe, overload, reverse engineer or resell the Service. We may decline, pause or end service to any business at our reasonable discretion — your account and its history remain yours per Section 2.
10. Liability
To the maximum extent permitted by law, PivotAd is not liable for indirect or consequential losses, lost profits, or losses caused by Google's decisions (including ad disapprovals, account suspensions or verification outcomes), and our total liability under these Terms is limited to the fees you paid to PivotAd for the Service in the six months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
11. Term and ending the agreement
These Terms apply while you use the Service. You may stop at any time; we may terminate with reasonable notice, or immediately for breach. On termination we disconnect our manager access (you keep your account, per Section 2), any unpaid Service fees become due, and Sections 6–10 and 12–13 survive.
If your paid plan ends — because you cancel it or because a payment cannot be collected — the campaigns PivotAd created keep running in your Google Ads account, where you pay Google directly. Creating and managing campaigns through PivotAd requires an active plan; your plans, accounts and business profile are kept so you can resume at any time.
12. Governing law and disputes
These Terms are governed by the laws of Denmark. Before any formal step, please contact us first — most issues are resolved quickly and informally. Disputes that cannot be resolved informally are subject to the courts of Denmark, unless mandatory law in your country of residence provides otherwise.
13. Changes and notices
